My wife and I are renting a condo in Brooklyn. The owner sent a deliver confirmation letter telling us to vacate in 60 days. There has been no problem. It is the end of the lease, but we want to renew. I called and she will not give any reason.

We have a normal lease. The clause with the 60 day notice requirement is if she sells the place, but she is not.

Can she just kick us out without cause at the end of the lease?

  1. I don’t think the non-eviction law applies in this context (though I’m not a real estate lawyer). Nor should it. This is a free market lease, you signed it knowing the rules (or with the full opportunity to learn them); it doesn’t seem reasonable to change the rules now.

    There are pluses to renting – but there are also downsides, and this is one of them.

  2. In New York State there is a non eviction law that states that your landlord can not evict you unless there is a non rent payments or she is going to move into the unit her self let her take you to court

  3. Yes, as a market rate tenant she can give you notice to quit in the sixty days prior to lease expiry. She is unlikely to give you a reason, even if you hound her, because as soon as she gives a reason, you have a potential action for discrimination. Unfortunately, there is nothing you can do except find a new place and book the movers. That is the one of the risks of being a renter in a free market.

  4. Yes she can. Lease is expiring and she is electing not to renew. Look for a new place.

  5. Most leases only renew if both parties agree to renew.

    The owner doesn’t really have to give a reason. Could want to sell. Could want to move in. Could want to let a relative live there. Could secretly hate you. If she doesn’t want to talk about it, she doesn’t have to (and, if she isn’t interested in changing her mind, that could be a good reason for not wanting to talk about it).

  6. Of course she can kick you out. It’s a free market rental. She’s not kicking you out anyway, the contract is up. Time to move…
