Law states you have 3 business days to cancel your contract with the Owner and have your money returned unless you missed any fine print in the contract where it states that by canceling there might be a small retainer held for the Contractor.
I do agree with mostly everyone here. Now as far as being Licensed, you do not need to be licensed in NYC to perform as a General Contractor for all work aside Residential, then you should be licensed by the DCA and even if you call them, its not mandatory, you can still hire a reputable contractor that has no license and still have the work done, but beware, your on your own if something happens.

My friend sure has learned a lot from this experience. The signed contract explicitly said that if the building board rejects the project then there will be a full refund. Hopefully, we will get to share a happy story than a sad one with everyone in this forum in the near future.

Next time check their docments first before you submit the alteration agreement to the condo or coop board.
to cancel a contract you have to give 72 hours notice (3 days). Legally it is called a cooling off period. send it in writing rrr from p.o.
Subah Construction was to renovate the kitchen/bathroom/wooden floor. The building board requires licensed contractor, licensed plumber, and must carry certain amount of insurance. But so far, no documents have been shown to prove that Subah Construction is legal to work in this building. I guess to work in this building, the contractor has to be DCA licensed?
you dont need a license to be a General Contractor in NYC let’s say to perform commercial, institutional or industrial work, only when performing home improvements does one need a DCA issued “Home Improvement Contractor license” & a “Home Improvement Salespersons license”.
absolutely right denton. a portion of the contract should read as follows.
“NOTICE OF CANCELLATION
YOU, THE BUYER MAY CANCEL THIS CONTRACT AT ANY TIME PRIOR TO MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DATE OF THIS TRANSACTION. SEE THE ATTACHED NOTICE OF CANCELLATION FORM FOR EXPLANATION OF THIS RIGHT.”
This is the “attached notice of cancellation” that my contractor emails me with the contracts that he performs for me.

Yes, I believe that both sides have the right to cancel. Subah Construction has not shown any license and insurance documents to prove that it’s legal to work at my friend’s building. How do we know if a company is licensed? Does it have to be New York licensed to work in New York?
lynchny, I believe you have the right to cancel a home improvement contract withing 36 hours of signing. Probably why he’s not calling you back.
