I have the same problems with these scum bags in queens. I live in the Opal a 80/20 so called luxury building. Can you believe these lying fucks registered my 1 br apt to DCHR for $5,500. This was three years ago! Can any body tell where in ***king Queens u can find a 1 br apt for $5,500 ?!

    I’M A LICENSED REAL ESTATE AGENT! Funny how
    people pass judgement without knowing who they are talking about! I’m sure there’s other options out there than the laW suit route.I was thinking of using DHCR.
    I pay $1,800 for my apt but the landlord is increasing my rent on the inflated $5,500 amount. I have access to the MLS and there is no way they can prove that a 1br apt goes for $5,500 in Queens,period.
    If any one have any other informative comments please let me know. Thanks in advance:-)

  4. Here the case law I will use to stop them their tracks!
    The Court of Appeals states in Thornton v. Baron, 5 NY3d 175,181 that:

    “A landlord whose fraud remains undetected for four years, however willful or egregious the violation would, simply by virtue of having filed a registration statement transform an illegal rent into a lawful assessment that would form the basis for all future rent increases. Indeed, an unscrupulous landlord in collusion with a tenant could register a wholly fictitious, exorbitant rent and as long as the fraud is not discovered for four years, render that rent unchallengeable. That surely is not the intention of the Legislature when it enacted RRRA. It’s purpose was to alleviate the burden on honest landlords to retain rent records indefinitely, not to immunize [*4] dishonest ones( like the Opal) from compliance with the law”.

  5. No its not a typo. Its on my lease and I called DCHR to verify.
    Here is how the scam works. They register a inflated rent amount to DCHR, call it the “Legal Regulated Rent” then rent the apt for the real market rent. So when they renew the lease they can use the phony amount they register to collect more than what they deserve effectively bypassing the rent stabilzation laws
