The contractor working next door damaged our house and was given a DoB violation and an ECB violation almost 2 and a half years ago. They are still working next door but the ECB violation says “pending”. The hearing date has come and gone. Why are they not in default? Why no penalty or fine? Anyone know how these things work? The contractor has not made any of the repairs ordered by the DoB yet.

  1. Have you pursued action against the contractor? Generally the ECB violations are for improper work practices, but do not result in substantial fines unless it is egregious activity. It is likely that the fines have been assessed but the online system has not been updated. You can submit a FOIL request to the department of consumer affairs to find out the disposition.
