Messy Trash by Tenant

We recently closed a property in Brooklyn while there is tenant in one of the floors. The seller already started eviction process and judgment was given for the tenant to leave by 7/31/07 (we have a copy of judgment).
There is large family living in this 3 bed room apartment. Tenants have thrown large amount of trash in front of the house in scattered all over including the food even though there are trash cans. Being new and not knowing, the trash was not moved to curb on Monday; when we went on Tuesday to the house, we found this horrible surprise (terrible smell, bugs etc.) and a notice with $100 fine from Sanitation service on the door.
We have cleaned (we have to throw even some of the trash cans and get new ones) and will have them outside for the next garbage pick up day. Ofcourse, mailing the penalty of $100. We are having difficulty in getting hold of the tenants and even have a decent conversation with them.
I am afraid we may face this until they leave and concerned we will keep getting these penalties until these tenants leave. Please advise what is the best way to handle the situation with the tenants. We are paying penalties for their attitude and un-hygienic behavior.

I know the Sanitation dept will fine the Tenants directly — I wouldn’t pay the fine, say it’s the tenants — Sanitation should send someone by to investigate. Seems pretty obvious who’s at fault, sanitation will ticket them instead.
Thank you for all your suggestions. Useful info. I was planning to go to original attorney (initially hired by seller) who attended the court on behalf of the seller and ask him to represent us until the eviction process completes. I am just hoping that they leave with out going through eviction process.
excellent suggestions anon 2:40PM…. a good idea to take pictures… should also prove the date, so have a newspaper documenting the date in the pix.
do you have the responsibility of calling the marshall several days before the eviction date if
the troublesome tenants aren’t out by then?
don’t get caught in a catch 22 and have to have the process of eviction start all over again…
find out in advance of the evicton date how yu have to legally proceed.
suck it up? f*ck that. tough sh*t they are being evicted. so now that entitles them to act like a-holes? don’t put up with it.
I would speak to the seller and see if they gave a security deposit.Not sure how eviction process works or effects that. I would ask seller to advise them any summonses incurred by them will be taken from security deposit and they will be taken to court for any other damages.If you have a camera, video and take still shots of apt now and when they vacate so they are aware you are documentating possible damage to property.Also , call sanitation and ask Supervisor for your area to meet with you at said property and explain the situation to him,. malicious problematic tenants deliberately dumping garbage due to eviction.He might be sympathic to you till they leave.Mine was. Take photos of strewn garbage as evidence if needed for court proceedings.Document and take photos.Good luck…..
If you are not in the building yourself or on the block, you will either need to visit the place every day or talk to your neighbors about a person who you can hire as another poster mentioned. This is a much better solution because it takes you out of the situation until the tenant eviction is over. Also the Sanitation Department is very aggressive and the fines can add up. I have a retired neighborhood man take care of the garbage for me since I have to travel for work and he puts out the garbage for me and puts the cans back and picks up the FLYERS which are everywhere. He does it for many people on the block. You obviously need to monitor this situation and the eviction is not pretty. Just hang in there and keep personal contact with the tenants who are being evicted to a minimum. Hopefully they will move without the whole Marshall/police scene, but it may happen. Hang in there.

Hope that they leave peacefully before the 31st… the enforcement of the eviciton with the Marshall and cops can be an awful scene… be prepared.
Hire a super to clean every morning. My experience is that good and bad tenants are equally bad when it comes to recycling, or throwing out the garbage in general. My prediction is that they will trash the apartment if and when they finally leave. Don’t take it personal. It’s just part of the package.
