Hi – I have lived in my rent stabilized apartment for almost 3 years and would qualify my relationship with my landlod as excellent. However, he has just sold the building to a new owner (after assuring us all in writing that our leases are all valid and carry over to the new owner). Well, I have not received a lease renewal (and I just realized it, my lease ends end of September). I got mixed up because when I origianlly moved in, my lease started in November but on my last renewal it switched to October, which I forgot. Anyway, does the fact that I have not heard word one from the new owner mean that I am getting kicked out? Do I have any rights as a tenant to stay in this apartment? If they are kicking me out, what is the notice requirement? If I haven’t heard notice does that mean I am fine until I do? On top of everything, I am going out of the country in a week for 2 weeks. If I come back and have a week to find an apartmetn and arrange movers i will be up a creek. Any advice, please chime in.

From NYS DHCR..
-Tenants in rent stabilized apartments have a right to select a one or two year renewal lease term. Generally, the renewal lease must keep the same terms and conditions as the expiring lease
-The owner must give written notice of renewal by mail or personal delivery not more than 150 days and not less than 90 days before the existing lease expires. A failure of the tenant to respond within 60 days of the offering may lead to eviction proceedings.
-A tenant should first contact the owner to obtain a lease. If the owner fails to provide a renewal lease, the tenant has a right to file a complaint with DHCR on form RA90, Tenant’s Complaint Of Owner’s Failure To Renew Lease And/Or Failure To Furnish A Copy of A Signed Lease
-The owner must register rents of rent stabilized units with DHCR on an annual basis on the Annual Apartment Registration (form RR-2A) and the Annual Registration Summary (form RR-2S) DHCR forms. A copy of the Annual Apartment Registration (form RR-2A) is required to be served on the tenant. You can find out your last registered rent from DHCR by contacting the Borough Rent Office and providing proof you are the current tenants.
worst comes to worst, you’ll go to month-to-month tenancy and the new LL must give you at least 30 days’ notice if they want you to leave. ask over at tenant.net, i’ll bet there are similar stories on their forums.
Hi – the renter here…I can’t reach out to the new owner because I don’t know how to contact him. I just sent my Sept. check to my old landlord. we haven’t been given any contact info for the new one (although I know the sale has taken place because another tenant told me). I left a message for my old landlord but I am not sure that will help me out. Maybe you are right, though, and the new owner just hasn’t dealt with it yet. Still, I have less than a month and then I will be living here with no lease, which scares me.
Why don’t you reachout to the new owner?
I think you don’t have a new lease because your new landlord has not dealed with it yet. If you have something on paper from your old landlord and someone is taking your money monthly, I don’t think you should be too concern.
