Protest Over Bed-Stuy Foreclosure

On Friday a protest will be held over the eviction that Mary Ward, a longtime Bedford Stuyvesant resident, is facing. A Daily News article about Ward, who is 82 and has lived in her home for 44 years, says she was the victim of a predatory subprime lender, Delta Funding, that went bankrupt a few years ago. Ward claims Delta said it would cancel the loan in 2001 but instead the mortgage changed hands several times and grew from $82,000 to $200,000. The group behind the protest, Organizing for Occupation, is exhorting residents to stand in solidarity with Ward and to decry “predatory lenders…destroying Bed-Stuy, intentionally stripping communities of color of their equity, wealth, and homes.” The protest will take place at 9 a.m. on Friday at 320 Tompkins Avenue.

    On the one hand, as I approach this I think:

    this sounds exactly the kinds of things that we hear about being the worst of the worst. sleazy greasy palmed telephone salesman dining on our little old grandmothers for lunch. old people get swindled all the time, but to lose your lifelong home is not the way to end your years.

    On second thought, as you click into the flyer:

    “No foreclosures in bed stuy”
    “Evict the scheming bankers and speculators from our community”

    hmmmmm…. i thought we were talking about the little old lady…

    From what I know (admittedly limited) the only rational option for people like her is to wlak away. The mortgage has changed hands and no one is bothering to pursue. Also, she is of an age where the total destruction of her credit (a catastrophic problem for couples or singles who walk away) is not going to be an issue.

  • I heard that you can’t evict renters over the age of 62. I don’t know if that’s true or not. If so, how can you evict a homeowner over that age, especially in a case that is so textbook an example of predatory lending? This lady needs a good pro bono legal eagle to cut through the crap here, and fast.The case is so absurdly and obviously an example of thievery that a judge needs to just step in and stop this whole mess. The DA and her legal team need to connect with the powers that be and put an end to this. Just quietly end it, so she can live her life in peace. Her case doesn’t need to become a political football for someone else’s causes, even if there is a kernel of truth in those causes. It’s times like this when I wish I was a very good, and very persistent lawyer.

    Jester, when you’ve been in your home for 40 plus years, just walking away is like losing a spouse. Where is she supposed to go? Who’s going to go through a lifetime of living in that house and decide what’s important, when probably to her, it all is? What kind of apartment is she supposed to get for her limited income? Where? More than likely far from her friends, church, social contacts, and comfort zone. I’m sure her credit rating is the very least of her concerns. She’s a victim, not a greedy homeowner who used her home like an ATM. She should not have to move anywhere.

    Of course I agree. I’m only saying the actions that others in a similar situation have done. It’s an absurd action but the calculus of this whole mess calls for it.

    We live in Bed Stuy and weekly we get the most ridiculous insane letters claiming to be official this and that promising us loans and government money etc — it’s all predatory lending and fraud.

    I’m not familiar with this group, and I don’t think they have much connection to Bed Stuy, but I’m thinking of going because I support the lady and I don’t like predatory lending.

    Fortunately, Mary Ward does have legal representation from Common Law.

    The marshall arrives at 9 am Friday to throw her out, I just learned. So the protest is scheduled for 8:30 am. I didn’t realize this gathering is to literally keep her from being thrown out of her home.
