Hi,
I have verbal agreements from the other two owners in our brownstone building that we can obtain roof rights (currently a common area of the condo). I will be paying outright for a new roof as compensation, since our building has very little spare funding.
The question I have is, what steps do I need to go through in order to get the condo bylaws amended to specify that we have roof rights?
Are there any attorneys out there who can assist with this sort of thing?
Lastly, what is a ball park number for going through the whole process?
Thanks.
Thanks all. Jock, I put a call in to Allyn and he will get back to me. I did speak with one attorney previously who quoted me a pretty high number in terms of getting the paper work done and filed (suggested that I would need an expediter amongst other things). nyc_sport, any idea where I can find the condo declaration? We bought the place last year and it came with the bylaws and original offering plan (for the original buyers), but that was about it. As for an addition, I believe the street is on the verge of being landmarked, so probably not an option. We are looking to build a roof deck.
Thanks 🙂
You need to amend the condo declaration not just the bylaws. You also probably want to be sure what those roof rights mean (i.e., additions vs. roof deck, assuming an addition would even be possible).
If the three of you make all of the decisions ahead of time… It should take a real estate lawyer about an hour to revise the paperwork, but I’m sure you’ll be charged for a lot more than that.
My favorite real estate lawyer:
Allyn Crawford, esq
(718) 273-9414
He will let you know what needs to be done and how much.
