I was wondering if I need to get a new CO or install a sprinkler system if I merge 2 apartments into 1 and move the occupancy or family dwelling of the lost dwelling unit to a legal basement instead. I was told this is easily done as the basement was at one time an existing apartment. Does it make a difference if the building is rent stabilized? The building was made in the 1930’s or 1940’s. Any feedback greatly appreciated – What to watch out for? cost? etc.

  1. If the building remains 3 or more families that will not trigger by default a sprinkler system requirement. The C. of O. requirment may in some instances also be waived but not always. if you need more speific details you can email me at brooklynexpediter@gmail.com for your options.

  2. What does the current c/o for the building say about cellar use? You can find your c/o on the DOB website. You’ll definitely need an architect to file for a c/o change, and to change any use, egress, or occupancy.
