We have a legal 2-family house. The top floor has 1 kitchen and 3 bedrooms. In the kitchen we’re thinking about removing the sink, the 1 crappy tiny cabinet on the wall, and the fridge. Then put a bed in this room to make it a bedroom. However by reading the DOB flier on construction…
We have a legal 2-family house. The top floor has 1 kitchen and 3 bedrooms.
In the kitchen we’re thinking about removing the sink, the 1 crappy tiny cabinet on the wall, and the fridge. Then put a bed in this room to make it a bedroom.
However by reading the DOB flier on construction permits, it appears that removing the kitchen table and replacing it by a bed would qualify as “use or occupancy change”, an Alt 1 change.
Is this possible?
Somehow I can’t imagine how moving furniture around would qualify us for an Alt 1.
Any advice on whether we should worry about this? Start worrying about filing permit etc?
it’s not the moving around of furniture that makes you need a permit, but the removal of a sink, which entails plumbing work.
There are many houses for sale that are described as 2-family currently configured as a 1-family. Don’t change the CofO, because someday a 2-family CofO can be more valuable to some buyers when you sell. People only have a problem when they try to add (not remove) an apartment without the CofO for it, thus creating an illegal apartment.
I wouldn’t worry about it(getting permit) unless you want to change legally change the CofO – which is probably not a good thing to do.
