Can anything be done if I receive a violation to dismiss it? I mean get a lawyer,try to legalize it, avoid the penalty? Also am I going to face another inspection (for the corrections made)? What about after that will they leave me alone? it’s a category 3 violation so I guess the least important one. Thank you in advance

  1. It’s a category 3 violation for an illegal extension, I guess in both DOB and ECB. I’m currently working with an architect to legalize it as I have a cure date(therefore I should avoid the penalty). Is the violation shown on the dob website the final one? What I mean is on the paper ticket I received besides for the extension it also says that a entrance door has been added and on the website under violation it does not mention that but under complaints->inspector comments it does. I did not build this door! They were there when I bought the house. It’s a new construction so I am the first owner. I checked the plans in DOB and they don’t have the doors on them either, but from what I also found out the construction had to pass the final DOB inspection before the building was given out for sale. So how did it happen with the door being physically there but not on the official approved plans. I don’t know what to do anymore. Any suggestions??? Thank you all once again.

  2. Not sure the specific subject matter of your violation but here’s what one should do in general:

    The colored carbon violation should state a time window for certifying correction. If you send in a satisfactory Certificate of Correction (C of C form is on the back of the violation)within the time limit, the violation should be dismissed without a penalty. Make sure that you’re very explicit with the back up for the C of C. Include pictures and an affidavit stating what has been done.
