Are the laws the same regarding heat in commercial rental spaces as they are in residential spaces? Basically I have been informed by my office landlord that there will be no heat or hot water this winter, and he gave me a space heater and said “just leave it on all the time” which i am obviously not going to do, i’m not looking to start a fire!
I have stopped paying rent (is that legal???) and plan on making a complaint with 311….do I have any other options other than to wait or move?
what if the space i rent seems illegal- like its obviously old apartments turned into studio spaces???
I’d say more than poised for an eviction — you will be evicted and liable for rent for the rest of the lease. (I think the law is still that the LL has no duty to mitigate in commercial lease unless the lease says otherwise.)
Agreed. Almost anything goes with commercial – a deal is a deal. Carefully read your lease about whether the landlord is supposed to supply heat. You may be poised for an eviction if you withhold rent and the landlord has no obligation to supply heat.
