Are all Class B Multi Family Dwellings SROs? Our offer on a brownstone was accepted. It’s just been renovated into a single family, but the C of O says Class B Multi-Family. The property overview in the DOB system says it’s not SRO restricted. What kind of issues might we face? The house has been empty for over 3 years so a cert of non-harassment shouldn’t be an issue. The seller seems willing to do what’s necessary to remedy, but it would help to know what I need to ask for.
As a follow-up, we went down to the DOB today and were told a construction permit wasn’t necessary for this particular property. The C of O indicates its a one-family duples on garden and parlor floors, with two rooms for roomers on the second floor and three rooms for roomers on the top floor. The recent construction just made the top floor a single room. So it seems we can file for the C of O change with just the architectural plans, and we can get the electric and plumbing work legalized with plans, licenses, and maybe some inspections.
Now we’re off to chat with an attorney about getting some money into escrow to cover this.
Class b initse;f does not mean it is a SRO but it is still a strong possibility and if it does not show in BIS you will have to check the C. of O. ot HPD website for what it shows on the I-card.
A class b is defined as an apartment for transient living and not permanent and are defined in the NYS Multiple Dwelling Law may be any of the following designations:
1. SRO
2. Hotel, Inn
3. Lodging, Boarding, Rooming, Furnished house
4. Hostel
Not all are restricted with SRO restrictions by HPD but it needs to be checked out big time.
Ouch, then this will be a legalization. There will be fines for the work. Since they are going from a multi family down to a 1 family that will make the legalization much easier. Good luck, be prepared to wait awhile, they need to hire an architect to prepare the drawings, submit for permit, close the permit, get the new C of O. Are you able to close without all of this being done first? If so, you could get the $$$ held in escrow and hire who you want to do the project after/during closing.
No, they didn’t pull a permit. Are the next steps for the sellers to submit drawings and have inspections for the alteration of use? This is making me worry about the quality of the renovation.
Did they pull a permit for the renovation changing it from a multi to a single? It does not sound like it.
