Question About Repainting Apartments in Building
I have a quick question. I have a three-unit building (not rent stabilized). Am I required to repaint my tenants’ apartments? If so, how often must I do this? Thanks!

We painted some rooms a darker color and the windows seem to still be the same size ๐
Dark colors absorb most light from windows -> room with a dark paint don’t have adequate amount of natural light -> HPD not happy. Think it this way: painting with dark colors is like reducing the window size.
I think it’s also good practice for the LL, as there may be a presumption against claiming any dmaages (assessed against the deposit usually) to the walls if regular maintenance is not carried out.
I know that some lead paint tests can not be used if the walls are painted a dark color. Maybe that is it?

For what possible reason could dark paint be a violation?
I decided to contact HPD directly. I was told by an inspector that I am required to paint every three years as needed. So if there isn’t any peeling paint and the tenants don’t ask, I don’t have to paint.
The inspector at HPD said that if I allow the tenants to paint the apartments themselves and if they choose a dark color, I could have a violation. Apparently, apartments should be a light color. That being said, unless there is a complaint about a possible violation, HPD cannot enter the tenants’ apartments. If they can’t see the color, they can’t issue a violation.
