We have a back deck that is in need of some major repairs or it has to be completely rebuilt. I’m looking in to the option of just rebuilding it.
The question I have is: if we replace the deck, do we need a permit for the work to be done? We’re not going to make any changes to the dimensions of the current deck and it was included in the floor plans when we bought the house. We are doing this for safety reasons and not just adding on to our house.

I imagine most people would think that building a deck is no big deal. However, it is and you should file. Every year I hear stories of decks falling in and people getting really hurt. Often it’s the case that a dozen people are on an old wood deck at the same time. Or it gets caught on fire because of a BBQ. It’s better to file and meet the code. Down the road when you sell, having a legal deck will be a real plus.
If the wood is closer than 3 feet from the lot line, then the deck was definitely built illegally. Maybe mcKenzie did it. 😉
If you are taking down a non-compliant structure and replacing it with a compliant structure, then I believe you are correcting the violation, and therefore should not get a fine for the previously completed work.

This is why I posed the question, because I am hearing so many different view points.
I don’t know if the current deck is up to code after looking at some of your posts. It is made entirely of wood and it is less than 3′ from the side lot lines.
Is this going to cause me even more of an issue?
mcKinzie: relax!! it is not that bad and there is also an expediter from staten island coming to brooklyn fromtim to time with the name of mcKinzie so please relax. Most decks are being done as alt-2 directive 14’s and you ain’t getting any violations if it is built according to code nd according to plans. The only thing is that a lot of these rules make very little sense but that is a part of living in the city and if you do your work legal then even if your neighbor rats you out you ain’t gonne get no problem. dunno what you did though
mcKenzie: It sure is easy to make those comments when it’s not your bank account on the line. How about you offer to pay all the op’s fines when the neighbors call? We’re not living in your old neighborhood, and I somehow doubt your old neighborhood is either.
tyburg: according to the latest revised international building codes governing back yards and barbecuing protocols, decks have to be made of titanium or, alternatively, recycled strollers.
you know what happens in Kings county when you file for a DOB permit for a deck? the examiner will give you four to eight violations for all sorts of things when he makes his final inspection. In a millions years have I ever or would I ever get a permit for a rear deack. And I have built three. If a neighbor rats on you, you have bigger problems than DOB permits. In my old neighborhood that neighbor would get a pot of “Brooklyn stew” on his deck. DO you know what that is? I didn’t think so.
It needs to be iron only if within 3 feet of the lot line otherwise it is ok to use combustible material.
Don’t decks have to be all iron or steel except for the decking?
