The certificate of occupancy for our coop states that the cellar is used for storage. Our unit has stairs linking it to portion of the cellar that is closed off (with a separate door for egress purposes). If we want to use this space as a rec room, do we need to file to amend the CofO? There is a 2 piece bathroom in the cellar, and it is currently sectioned off into two parts. I already know it does not meet the minimum ceiling height and light requirements to be “habitable.”

  1. He was asking what was legal. Park Sloper, DOB sees basements (more than half out of the ground) from cellars (more than half in the ground). The co-op most likely will not allow it to be used (if they know about it) other than as listed. Maybe they have a don’t ask don’t tell policy in place.

  2. OP, if you’re not doing anything beyond painting (no reno), why does it matter what the CO is? It’s your space. You can put in a still, a ping-pong table, a home video and lots of other things. The DOB won’t get you.

  3. I have a basement rec room, that is listed as such in the C of O. I use it as an occasional guest room, and bedroom for my college-age daughter when she’s home on break. Why is this not not okay or smart? There are two means of egress, and a half bath which was built to code. And regarding the C of O itself, does one that calls the basement storage space really keep the owner from using it as s/he sees fit?

  4. A rec room isn’t a “living space” is it? I thought the only really strict bits were bedrooms and kitchens… Otherwise, you’re not living in that room, you’re just recreating once in a while.

    If you can go store and unstore things in there everyday, all day, why couldn’t you set up your S&M dungeon there? (Or whatever you have planned, of course)

  5. It would not be o.k.(or even smart) to use as a bedroom.
    Forget the CofO. If it attached to your apt…use otherwise as you wish.
