Friends,

I have been in light discussion with a buyers broker about the type of place I am looking for. He has been sending me listings, I have gone to a couple of open houses with him, and he calls me all the time. The thing is I can’t stand this guy as a broker.
I never signed anything saying he is my broker, but in an email said “fine” you can be my broker.

If I find a place on my own, am I contractually obligated to put him as a broker?

  1. frankly, i dont understand why people dont use buyers brokers more. the commission doesnt cost the buyer anything. it sucks a bit for the buyers broker but not for anyone else unless youre gonna negotiate the brokers fee down.

  3. We had to shake off a few of these in our purchasing process. It sucks but we found it most effective to say, thanks, but we’re working on our own. If we need anything, we’ll let you know.

    Also may happen that you’ll see him again as broker for a property you might like to buy, so be firm but not rude when you say no thank you.

  4. You are not contractually obligated to do anything. If he showed you a property and the seller’s broker has him down as your broker then, if the seller’s broker is sharing commissions, he will get his if you buy it.

    As far as looking at stuff on your own, no obligation. Once you’ve looked at something on your own though, don’t expect to bring your broker in at a later time to get a poiece of the commission. Sign in sheets at open houses ask for all this info to avoid problems later.
