Lease Extension Denied
My lease is up at the end of the month (jan 31). rent stabilized, been there for years. I’m moving on Feb 28 so I requested a month extension from the management company (one of the big, huge, evil ones…) and just found out it was denied. So what are my options? I can renew…

So what are my options? I can renew the lease for another year and sublet for 11 months (after I move out)… or some people are telling me I can just stay there?
What do you folks think is my best course of action? I’m happy to pay rent for the month of Feb–as I definitely need to stay there.
From what I understand, eviction proceedings take a long time, but will there be any ramifications if I just stay there and send in my normal rent check?
Any help will be GREATLY appreciated!

no, i’m the prime tenant. my name is on the lease. i’m not subletting at all. i only mentioned “sublet” in that one option of mine is to renew my lease for a year, stay the month i need to stay, and then find a subletter for the following 11 months.
Send them the rent check. They won’t cash it until they realize you’re going to stay the month. They’ll threaten to put you on the blacklist but they will have to follow through with an actual eviction but you be long gone by then. Once they cash the check any listing of the eviction would be considered frivolous and without merit and therefore “unlisted” because they would discontinue the action.

They probably don’t believe that the prime tenant is still entitled to the apartment. If the prime tenant has been subletting it for “years” They actually may have a point. They have to serve a hold over after the “lease”/sublease ends….it take more than a month to get someone out….more like 6 and that is fast.

nope–no one has seen this apt. they would have to do a decent amount of work before renting it out again. and i still can legally renew my lease as far as they’re concerned.
yes, it is one of those huge giant management companies.
so it sounds like my best course of action is to send them a check for feb’s rent and a nice letter saying “i will vacate on feb 28. please find enclosed the rent for the month of february”
i’m cool with the super. i’ve told him what’s up and he said that eviction takes forever and he’ll call me if he hears anything.
the only annoying thing is that i’m out of town until feb 3 so i can’t even be there to stand my ground…

has someone come and seen this apartment yet? did they maybe already rent it out to someone starting that month? it just seems really weird why they wont let you stay an extra month. do you complain to them alot?! are you cool with the super? you could always just put your stuff in storage and couch surf or something.

Oh, and offer the owner a few extra bucks – for you it is cheaper than paying for storage or any potential legal fees, for the owner, it is found money off of a rent-stabilized apartment.
Call the managing agent, or better, the building owner directly. On the face of it, your request seems very reasonable, but it may be that there is a legal reason why they don’t want to extend (any landlord attorneys here?).
unless they really drag your butt into court, there wont be a record of you just staying there an extra month. so just stay there an extra month. but make sure you pay for that month. if it’s one of those giant management companies, they’ve been thru it before, and there is a ton less hassle letting you stay there a month.
dont let big bad landlords scare you. it’s a renter’s city.

I agree with Nokilissa, and I think the chances of such a course of action resulting in negative consequences for you are next to zero. You would have nothing to worry about.
