I was hurt at work back in July 2009 and as a result fell behind on my rent and bills. My job which initially didn’t want to take me back until I filed for Unemployment finally did, but at 2/3rds of what my pay was.

I managed to pay off my Phone, gas (National Grid), and electricity(Con Edison). Six days after I paid the electric bill fully I get a bill for the same amount, plus $112, which from what I can tell is not what I owe but a “deposit requirement”. Basically the letter says that my electricity will be cut off if I don’t pay it.

Not being homeless is my priority and I’m not going to be able to pay anything until the beginning of February. And that still won’t be a $112 deposit.

Can someone advise me on whether or not I have any legal recourse?

  1. Ditto to what mod said. I’ve had this happen before. Con Ed will waive it as a one-time courtesy. After that, any late payment will result in a mandatory deposit.

  2. Call them. Their customer service number is: 718-643-4050. They also have walk-in customer service centers at One Metro Tech Center and 1535 Pitkin Ave. They have a financial assistance program, can’t say whether you’d qualify.   3. Call them. Explain what your situation is. They can waive the deposit or break it down in increments. It’s hardly worth it to them for $112 to bust your chops.
    Legally I don’t think you have any options.
