I have a situation in regards to this Violation Re-issuance Program. I received this paper from HPD in August stating to fix 2 violations from 1997 before I acquired the house. I fixed the violations before the cert date and mailed in the form. My problem now is that I am refinancing and cannot move forward until these outstanding violations are removed. I called HPD to find out if this was possible but she said that an inspector could be out in 90 days which would be a disaster for me. So I went on the website and it said that if the inspector did not come to inspect the home within 70 days on the 71st day the violation will not out of their system. Is there any truth to this? How can I can get the inspector to come and inspect faster so that my refi can go through?

  2. I did not visit Gold St. re: violations; my visit concerned another matter. Our violations were removed via our self-certification and inspector’s on-premises confirmation. From my vantage point, and considering the timeframe of your refinancing, nothing for you to lose but the travel time—whether setting up an appointment with inspector, or having them clear the books because more than 70 days elapsed without inspection.

I can’t say this will work for you, but I can say that on the occasions where I’ve had to visit HPD in person at 100 Gold, I’ve gotten excellent and immediate help: HPD, Division of Code Enforcement, 100 Gold Street, 4P6, New York, NY 10038. The 70-day period OP just cited is addressed in the link below, but I would say it’s open to interpretation. We also received reissued violations, and certified correction by the stated deadline. Only through neighbors did we find out that HPD visited our premises to inspect themselves without an appointment and without leaving notice. A few days later they returned, again without an appointment, and we were home to walk them through the premises.

  5. Apparently so….once you certified that on the yellow form that it was done and have it notarized…below is what is posted on their site.

    Reissued violations that are properly certified by the deadlines, and are not inspected by HPD, will be deemed corrected and removed from the Department’s open violation database 70 days from the date the certification is received by HPD. Re-issued violations that are properly certified by the deadlines, and are re-inspected by HPD, will be removed shortly after HPD’s re-inspection confirms that the violation is corrected.
