So, I have a dilemma. I viewed an apartment with broker A. Loved it. Wanted to jump on it. Broker A said to fax the application to her so she could get it right to the managment co. I faxed. Waited for her call. Nothing. So I called and left a few messages. The next day, called the management co. to see if they recieved the app. They said no. The same space was on CraigsList again with a different broker, B. I called him, said I’d seen it yesterday and wanted the place. He said great and I got him all the paper work to apply and he was very fast with it. In between, broker A calls, says she misplaced my app. and would now get it right to the management co. I informed her that we broker B has taken over my app. She flipped out. Bad mouthed us to the management co. Said she was going to sue me. Management co. would not accept our application after whatever she said to them (I have perfect credit, references etc.).
Even after the fact that I’m not getting the apartment, all day she has been texting me saying she will see me in court etc. Basically, I’m wondering what I can do. This broker is incompetent, crazy and vindictive. Is there a place to report this behavior? Can she take me to court for anything? I never signed anything or made any agreement with her whatsoever. Sorry such a long post, but I’m hoping someone will have some advice.

  1. correctionfluid- she has no case. You signed nothing and she didn’t get back to you in a timely manner. In addition to that, the powner posted the property with a second broker so they had no exclsive contract. I agree with vanburenproud- this person is not worth egaging because she is so obviously crazier and far more vindictive than you could ever hope to be. but defending yourself is not engaging and if she keeps harassing you, go to the police and speak to a lawyer, and the REB.

    I really appreciate everyone’s advice!
    I have saved the text messages from her, and now that I feel confident that this lady has no leg to stand on, I’m basically just hoping she goes away. I have a feeling she may have been trying to scare me to extort some money (I guess that seems obvious now). I also imagine there are probably “honest” and “helpful” brokers for rental apartments out there. However, just because this is the worst experience I’ve had, it’s not the only bad one.

    I don’t think you read the original post. Wrong side of Brooklyn? Ouija board? I called the agent crazy because of the legitimately crazy behavior described by the OP.

    To clarify: you suggested suing because the broker cost the OP time and money by behaving negligently.

    In order to do that, the OP would have to inflame an already ridiculous situation, in which this broker is calling him off the hook and threatening to sue him.

    I stand by my assessment that this would be mean (better to pity the crazy lady than attempt to game her) and fruitless (no sense fighting with a crazy person)

  4. I’d be sure to keep very careful documentation of your interactions w/ her in case she does pursue it. Diary entries w/ details, recorded phone calls, saved emails & the like will help support any arguments you may have to make later.

    a crazy person. I guess you have a crystal ball or maybe a ouji board.

    I am not defendng the brokers action. The op has to think how to deal with the problem to get past it and feel ok.

    Being petty isn’t going to help. It is going to prolong it and your goal gets lost.

    It’s good advice. I probably won’t pursue it, unless she really does file for some sort of small claims. I will be warning folks never to use her as a broker though. I want to post her name on here, but she’ll probably see it and sue me for libel.
