Interested in a brownstone being sold as a 2 family, but when checking with the DOB, the last C of O was filed in 1967 as a four family. Obviously there was some construction done since then, as there are only two apartments. Will I have an issue if we purchase and convert back to one family when we file for a new C of O?

  3. Misty – since you will be filing for a new C of O, the existing conditions shouldn’t handicap you at the Dept of Buildings. There is another issue with the taxes – actually in your favor – 1 and 2 family buildings are taxed at a lower rate than 4 families. I do suggest that you talk to your favorite design professionals and your lawyer before you make a commitment.
