My house needs urgent repairs in a part that is only accessible from the neighbor’s property.
I have been trying to get permission from the neighbor’s management co for very many months but they are unresponsive at best.

Looking through the archives I found some comments saying the law provides for this situation, and I have the right to access their property in order to maintain mine. Moreover, some comments suggest there are aggressive lawyers that can get me access really fast.

Have any of you hired a lawyer with that purpose or can you recommend an aggressive one?

  1. I would look for a good lawyer rather than an aggressive one. An aggressive may waste your time and money with trivial bickering that leads nowhere. And good lawyers generally don’t need to show aggression to get their way.

    If what you are looking for is a confrontation, then do it yourself.

  2. I would recommend a real estate law firm with a litigation group. I don’t know if you necessarily need an “aggressive” lawyer but one who will get things done in time and knows what paperwork to file, who to talk to you, etc. Email me offline at wettera1@hotmail.com and I can give the email address of our lawyer as well as any other info you might need.

  3. You need to find a lawyer to petition the court for a license to access adjoining property. You will also probably have to post a bond and the judge might require other conditions such as working hours, method of protecting your neighbor’s property, and use of licensed contractors. The ball will pretty much be in your neighbor’s court (no pun intended) regarding conditions.
