Quick question. We had a central air system installed in our attached townhouse. The steel beam on which the unit rests is placed on the parapet walls. One of our neighbours says that half of the parapet wall is his (i.e., if the width of the wall is 8inches, then 4 is his and 4 is ours). He says that the beam takes up all of 8 inches (it doesn’t hang over) and that he doesn’t have a problem but if he sells the house, purchasers may have a problem.
My contractor is telling me that the parapet wall is common and that is not shareable 50-50. In other words, it belongs to both of us and that it is standard to have unit installed like that. Anybody know what the right answer is? Many thanks!

Could you tell me who you used to install the central air? We have been waiting since April for the company who installed it to fix our system. They come over about 3 times a week and it’s still not fixed. i’m about to give up on them.
you can only use 1/2 of the shared wall.
You’re property line only goes to the center of that wall.

What’s BOD? Bepartment of Duildings?
It’s a common wall so 100% of it belongs to both parties equally (not 50% to one and the other 50% to the other).
A neighbor recently had a nasty encounter with BOD because of a rooftop A/C installation. In addition to a fine for unpermitted work, BOD required him to get the written consent of his neighbors sharing the two party walls for that structural steel undercarriage.
We were told (by our constractor and our R.E. attorney) differently – so the steel beams were sunk into, not attached on top of, the sharing wall – and sunk in only half way. We also had to get written acknowledgement from our neighbors on each side beofre it was ever installed.
