So I am trying to sell my place (FSBO). I have very specifically stated no brokers on all my ads. I keep getting a call from one broker in particular. She calls me just about every other day. She does not identify herself as a broker but I know who she is and I know who she works with. I have told her in no uncertain terms to NOT call me, I don’t want to use a broker and I wouldn’t use her if I did. I have told her if she insists on calling me I will report her to the state for violating the Do Not Call registry (I know brokers/agents fall into this catagory). Yet she continues to call.
Short of ripping her a new one anyone have any suggestions?

  1. Set up your phone to only accept unblocked callers. The broker will probably stop calling you if she knows her number and identity could be traced.

    How hard is that?

  2. Go along with it, set up appointments etc. Just don’t show up, when she calls you say sorry I forgot it was today, other excuses etc. a few times of her showing up for nothing, and she will learn.

  3. I would go to whomever her boss is at Elliman, first. Elliman surely does not want the publicity for this kind of behavior. Tell them she either knocks it off or you take it to the State, to the blogs, whatever. Keep notes of your conversation with Elliman — who, when, what was said etc. Also keep a log of the calls — how often this agent leaves messages, etc. Then, if you need to go further, you can add that you went to Elliman for help and it didn’t stop.

  4. OP here: she blocks her number but in her message she just states her first name and that she’s calling me about my apartment and could I please call her back. The first time she did this, I did call her. Immediately she launched into how beautiful my place looks and that she just sold something across the street, blah blah blah. First time I told her I did not want to use a broker (as my ad stated) and to please respect that. Well she has called me now just about every other day if not every 3 days. Her call is blocked and she only says she’s calling about my apartment. I know who this broker is. I know who she works with (Elliman). I don’t like her in general and I would’nt use her even if I were to use a broker. I told her I would contact the state if she continues to call me. I guess that’s the bottom line. I will tell her that if she calls me one more time I will expose her on every blog I can think of….should I do this?

  5. You can report her to the NY Real Estate Board for harrassing you. She has to work under their guidelines and rules in order to be licensed.
