I’m having serious roofing issues as of late. The brownstone next door stands 1 story taller than my own. During these past downpours the entire top floor apt ceiling leaks (very badly). After ripping down sheet rock it seems the beams are soaked. Upon further examination of the roof it appears that my neighbors wall is poorly flashed allowing the water to run down the wall into the beams. My question is ” Am I soley responsible for the fix or should my neighbor be held accountable. Thanks in advance

  1. You should get a knowledgeable roofer to try to determine the source of the leaking, which, by the way, is not an easy thing to do. If there is water seeping into the space between the houses from your neighbor’s wall, then it should be your neighbor’s responsibility to fix the problem. Is your roof showing any cracks? Is your parapet wall properly capped? Is the point where your parapet wall meets your neighbor’s wall properly sealed?

  2. sounds like your problem to me. Unless they are diverting water onto your roof then they shouldn’t be responsible. The problem is that your building isn’t properly sealed. They just have a wall that is on their lot line.

  3. It’s not legal for your neighbor to drain water onto your roof. If that’s the problem, then it’s your neighbor’s insurance who should pay for your problem. If it’s a different problem, I smell a lawsuit…
