My neighbor has decided to park his car in the front garden of a brownstone. He took out the front fence, put in a bowfront gate that hangs out over the sidewalk about a foot, and has painted the curb and sidewalk with yellow spray paint “no parking” and expects to keep anyone from parking in front of his house. I am sure this is illegal and am not sure who to report it to. Dept of Traffic, precinct, community board? Any ideas?

  1. I own a Komatsu (Excavator) and would loan it out 2 anyone to park in front and prove a point, but wtf. I say you plant a tree or a fire hydrant in front of the fkers driveway

  2. I have a friend whose neighbor has an illegal driveway. She tries her very best to make sure that cars aren’t parked in her driveway, that she goes as far as calling the cops. The cops actually issue tickets from what my friend explained to me. I was suppose to follow up on this, and wasn’t until this post that I remembered. My friend was given at least 4 parking tickets in the last 2 years as a result of this illegal driveway. All the other neighbors have been getting tickets do, and calling 311 doent seem to help. Nothing has changed. Any insight?

  3. Assuming you are in NYC… a permit is required from both the Department of Buildings and the Department of Transportation for curb cuts. There are a lot of restrictions on where they can be installed, and they must be inspected after construction.

You have two issues here: one is the illegal driveway, and the other is the encroachment on the sidewalk.

Here is a link to the DOT Street, Highway & Sidewalk Construction Complaint Form (I believe your neighbor’s gate falls into the “encroachment” category):

    http://www.nyc.gov/html/dot/html/permits/hiqaform.html

However, the Department of Buildings (not the DOT) handles illegal driveways, so you can contact them about the parking in the front garden issue.

Either one of these violations will result in a fine and (hopefully) an order to restore and/or repair the sidewalk.
