Confirming New Building Rumors
I was speaking to some neighbors who insist they have been hearing the new project at 574 Fourth Avenue, featured several times on Brownstoner per link below, is actaully slated to become housing for recovering drug addicts with a drug clinic on the first floor.

Forced Air Humidifier
Looking to install a whole house humidifier on our central air unit. Anyone know who I should be calling to perform the installation? HVAC company, plumber? Also any idea of the cost to install? I have seen some of the units go for $150-$250.

Yellow Water
So yesterday I noticed that the water coming from our taps, toilet, etc. had a yellow tint. This is true for both hot and cold even after running it for several minutes. This has happened before and usually resolves itself within a few hours. Everything is back to normal, but I was wondering if this is as common for other people and if their is a known cause or danger.

Intercom Wiring
Trying to get some ballpark figures to compare to a quote to re-wire an intercom system for a 4 story townhouse.
Basically entails running a wire to replace an existing wire that is faulty. The quote we got seemed a little excessive to run a wire for an existing 4 intercom system. Anyone that has any experience with this or something similiar and would care to share what it should cost would be greatly appreciated.

Condo Insurance
Can Anyone recommend a good agency for condo insurance? I think it is about time I get some. The builing is insured, but I need something for my contents, finishes, etc.
Also, if anyone can share what their rates are, that would also be appreciated. Looking for $150K Policy with a $1000 Deductible.

Impossible to Find Landscape Contractor
We have been trying to get bids to do a medium size landscape project in our 20 X 40 yard. Basically, removing topsoil, laying pavers or decking, edging and maybe a drywell.
Problem is, we cant even get anyone to return our calls much less come out and provide a bid. I have tried at leat 10 local contactors over the last 6 months and only 1 has even come over to look at the space. That person said they would provide a bid and never did. What is going on in the landscape world? Is there such a glut of jobs out there that no one is even remotely available. I am considering starting my own landscape company since there is apparently a severe shortage and wide-open market.
Seriously though, can anyone offer any suggestions or help?

Water from Neighbor Yard
I recently discovered the source of some serious water issues in my yard. Apparently our neighbor has built an extension to their building prior to us moving in. The bottom part of the building has a steep concrete slope that angles toward our yard and when it rains water pours off of their building down the slope and funnels directly into our yard.
This has caused serious issues including overwhelming our drain and flodding the basement and washing debris from their alleyway between the buildings into the yard.
I have been told it is not legal for their building to be designed to make their water problem our problem. I am planning on building a low wall on my side of the property between our fence and their yard that will no doubt create a narrow swimming pool in their alleyway when it rains. But before doing so, I was wondering if anyone can confirm if they are definately in the wrong (illegal, etc.) and what recourse I would have to force them to solve the problem?

Backyard/Garden Landscape Contractor
Looking for some recommendations for a landscape contractor to do some pavers and soil removal.
Looking to lay pavers over an area of about 18' by 30'set in gravel and sand and remove about 6" of soil.
Anyone do anything similar recently and have a contractor they recommend? Any idea what this project might cost? I am assuming it is about $1,200 - $1,500 for the cost of materials.

Anyone go to the "Vue" Open House This Weekend?
Hey Brownstoners - I went to the "Vue" Open House this weekend and aside from the shockingly high price tag, I found them to be decent in size and quality - especially on the upper floors with an amazing view.
Just wondering if anyone else had an opionion especially since I might actually consider an offer, but am wondering if maybe prices will drop a bit.

Definately take Denton's advice to heart, but to make you feel better similar things have happened to before on more than 1 occassion.
Typically, either someone with the same last name or similar name and address disappears and the collection agencies, being particularly agressive, will try to track them down and may mistakenly harass you in the process.
As Denton said - yelling at them usually makes them go away.
Checking your own credit should have no affect on your score.

Definately fugly, but as a rental it will probably fare OK. Very close to transportation and a significant discount to renting a few blocks east - hopefully.

Gabby - Thanks for following up on my point re: the drug rehab. I knew it sounded ridiculous when I heard it, but you never know. I e-mailed the Community board to see if they knew anything. Glad at least the developer is dispelling the rumor.

Bobjohn - The OP is attempting to avoid the mortgage tax on the refi since this is not actually new money. In order to do this the original bank has to agree to assign the mortgage to the refinancing bank. If they do not allow him to do this, he has to take out a new mortgage and use the proceeds to pay off the old one as you are suggesting - but mortgage tax will be charged in the process.

Reading through again, I would like you (all) to consider that talking to this woman in the context of violating rules and potential eviction may be the worst thing you can do. Outside of expressing your concerns and indicating you will call the police, I think it is a very dangerous game to try to move to evict someone based on "Allegations" of illegal activity. You will open the board up to all kinds of potential exposure incuding, harassment, libel, slander, etc.
You indicate the main problem is the woman's son and friends hanging out IN FRONT of the building making noise and potentially engaging in illegal activity. This is not grounds to evict someone since it is outside of the building in a public area. That is a matter for law enforcement not a coop board.
If you want to confront her based on the noise - fine, she should do something to curb it. But if she does not and you want to move forward with more aggeressive measures, you had better be prepared to provide hard evidence of illegal activity going on IN HER APARTMENT, otherwise you are opening yourselves up to serious legal problems. Frankly I dont see any way you are going to be able to do that without a police raid anyhow.
Simplest safest option is to tell her to curb the noise, and then start calling the police and let them figure out if anything illegal is happening. Trying to evict a coop owner and board member because her son has friends hanging out outside in a public space and accusing her of harboring and facilitating drug deals in the building sounds like an awful mess for a coop to get into.

Best thing is to just call the cops and let them know there is a large group of people disturbing the peace and selling/using drugs. They will come, dispurse the group and keep an eye on them for a while. Eventually they will get the message and find a new location to loiter. You are NEVER going to be able to evict someone because her son gathers his friends outside of the building.

The board will do nothing, they cannot enforce anything that is not specifically spelled out in the bylaws.
Even then, you will have a hard time proving it is excessively loud. Especially since the OP mentions it is not occuring after 8PM. Most bylaws state that noise must be curbed after 10 PM.
The board of a condo is essentially powerless.

Hate to be a downer, but what is the condo board going to do? Even if you 'Get Them Involved' - A. It sounds like a small building, so they are probably self managing and of limited experience, and B. They have absolutely no recourse.
Further to what Stonergut commented - Is it really that bad? I live above running kids and they are usually just noisy for a few hours during the day. Its also not that LOUD. Is it 20, 30 decibals? More? Less? is it as loud as a jet engine? I doubt it. Quiet enjoyment is one thing, but it does not imply "silent" enjoyment. Again, I repeat -The condo board cannot do anything for you unless they are exceeding some very high decible level at night (Usually past 10 PM). It is not a coop and they have virtually no power over an owner's behavior.
Also - You guys mentioning 80% floor covering...I have never seen that and it most certainly is not in my condo paperwork. Where does that come from? Maybe only applies to rentals or coop's or something.

Mopar - I am a CPA, I understand there are 2 ways to "Cheat", 1. Under report income, 2. over report expenses/deductions.
To the OP - I am aware of the "Legal" magic your accountant works (See 1 & 2 Above) Reporting personal expenses as business expenses (or claiming nonexistent expenses)is very common way to do this. The result is the same - Your taxable income is reduced so your lax liability is reduced.
I dont really mean to come off as a jerk, I just have a theoretical problem with people who want to have their cake and eat it too. I just think it is a hypocrisy that needs to be pointed out.

Wonton - I dont make tax code, but it is pretty clear if you make 100K and only report 50K, you are a tax cheat. I'm sorry if you feel over burdened by higher tax rates and regs, but that is the law. Talk to your congressman if you feel over-taxed, thats what I do. If you want to only pay tax on 50K and then whine because you want a bank to base its decisions on how much you "really" make, you deserve the grief that goes along with your windfall.
And speaking of all of those taxes you take care of that employees dont, what about all of the benefits and finacial assitance self-employed people qualify for because they show low income. I have a neighbor that just got a low-income subsidized apartment because she "shows" $35K even though she makes over $90K.

I am in a small condo where we self manage. Our "Reserve Fund" is generally for things like future projects we want to do, i.e. upgrading common area elements, facade work etc. and it is also there for unforseen repairs. We try to maintain around 10K in the fund but it could be significantly more or less depending on what projects we have completed or are in the pipeline.
In general, anything major like a water main or accident is covered by our insurance policy. If we need to repair the roof or something similar, we will have to all pony up the funds through an assesment. If one cannot pay, obviously a situation arises where we would be forced to invoke power of attorney rights all owners have over each other. Worse came to worse, we would go forward with the repairs and then sue the non-paying party even resorting to foreclosure if need be.
This is a remote but still possible risk in owning a condo. However it is no different than the same risk you take on when buying an entire property yourself, only in this case you are spreading these costs out bewtween multiple parties. There is no way you will get any meaningful finacial info on the other owners prior to purchasing as this is not something that would ever be disclosed. The only useful info will come from an inspector's/Engineer's report on the building.

DIBS - A Child's behavior is incredibly erratic as I am learning. Your 20 minute "Fitless" encounter is no measure of a child 24 hours a day. They can turn on a dime and it is part of the cahllenge of parenting.
Nothing against gay couples but I dont think there is any evidence they parent any better (or worse) than anyone else.

The integrity of the NY Times and it reportage have been severely eroded if not completely evaporated over the past several years. When you get your credit report make sure you don't accidentally "allow" them to take money out of your bank account for any kind of "protection". One of my friends did that and now she is seeing that charge on her debit card every month, with of course nobody that can be reached at the agency... I googled that problem and found quite a few complaints!

Check your credit report! We had the same calls and letters for awhile and never thought much of it until we tried to purchase a vehicle and got denied tier 1 financing--which we figured we were eligible for based on earlier credit reports. We found out that the person with the same first and last name as my husband (different middle name) is a pretty bad guy (he's wanted for felonies and assaults) and it eventually affected our credit report. It has taken weeks to correct and we're not sure if its fully done.

The next time you get a phone call from the bill collectors, simply tell them they no longer have your permission to call your number. By law, they must stop calling your number as soon as you tell them that. I am not 100% sure but the same may apply for the collection notices you receive in the mail.

Agree with Vinca. You need to make sure this is just some kind of weird coincidence and that you're not a victim of identity theft.
You can check your credit report for FREE once a year, from equifax or one of the other companies. Don't pay for any upsells--it should be totally free.
You might also want to put a freeze on your credit report. This means no one can run a check on your credit until you unfreeze it. Which is useful because if someone has stolen your identity and tries to open up a credit card, the credit card company will run the credit check, see the freeze, and refuse to issue a card. Downside is you have to remember to un-freeze it if you want to do anything that requires your credit--but that's for things like credit cards and buying a house, so it's not like you shouldn't remember. Sometimes when a person seems to disappear off the face of the earth, their creditors start looking for them and find people with similar names. I used to get calls at work from my bank about someone with almost the same name who was not paying his mastercard bill. Eventually they realized they were calling the wrong person. I actually use a credit monitoring service offered by Bank of America - it gives me peace of mind knowing that I'll get an e-mail every time there's a hard inquiry on my credit report, and they send me a full report quarterly. Maybe it is a waste of $12.95 a month, but what the hell, it's less than the cost of a bottle of mediocre wine.

This is a little different, but has some similiarities. I used to come home every day to dunning phone calls from the Municipal Credit Union for a person who used to have my telephone number. It went on forever, despite my attempts to contact them and get my number off their list. It was driving me nuts and when the people started getting nasty to me, I decided to really give them a hard time. I contacted the NYC Department of Consumer affairs who registered the complaint and then told me to write to the NY State Banking Department. I finally wrote a letter to the NY State Banking Department. I got a letter back from them and then a letter from the president of the freaking MDC saying sorry, blah blah blah. And it finally stopped. But for you, it is definately possible that you could be incorrectly tagged with this problem. You should complain to NYC Consumer Affairs, the NYS Banking Department, check your credit reports (three agencies) and if it persists, write letters to the three credit unions telling them of the possible confusion. Like Donatella, we have a different but similar problem. The ne'er do well son of the former longtime owner of our house (now deceased) who hasn't owned or lived here in several years still to this day puts our address as his, with the DMV, with car rentals, with Social Security, child support and employers. And the mail always somehow looks like he's in trouble for something at any given time. I put each and every piece of mail back, with "return to sender, incorrect address, please correct your records" on it but the mail for him still comes in waves every once in a while. I just can't believe places like the DMV don't make sure a home address is correct - don't they require a utility bill in their name or something?

What do you mean by executed? In NY, until both sides sign the contract and the downpayment money is deposited, you have nothing. Verbal representations are pretty much worthless.

I am not a lawyer, just a CPA with some experience in Business Law.
My understanding is that when it comes to real estate, the actual contract must be in writing stating all terms. Contemporaneous and verbal agreements are essentially unenforceable.
That is the depth of my limited knowledge on the subject. Hopefully a real estate attorney will chime in with something more concrete.
