If, on the other hand, it's causing real problems, talk to your landlord first. I don't know why people just can't be bothered to talk to one another first.

I have a sense of humor or lurker wouldn't be my name. (and, er....Son of Sam? sam can be a little creepy too, no?) I'm a long time b'stoner (NO- not another What alias!). For the most part you seem like an ok guy, but you have your moments- usually in regards to Crown Heights. I happen to love Crown Heights and Bed-Stuy and get tired of people snarking them.
Would love to do what you do though, but I'm tethered to Mr. Computer. I work from home, so it's not all bad.

Oops- and for my gratuitous comment: Love the house, too much money by half, hate knotty pine and can't say from the [picture if it's original or not but it looks too modern to me and the fireplace looks like it was modernized. But that's just my impression from the pictures.

Why not just ask your tenant what the deal is? I agree with THL- it's most likely a portable, and your tenant may not realize even a portable should have your permission first. Don't write scenarios until you know more from the tenant. If she's a good tenant, like you say, why let a misunderstanding cause problems?
Too many posters here want you to jump the gun and start poring over every tenet of the lease- talk first.Then you'll know what you need to do.

cmu- Agreed that some drivers are enraged by them, but that difference from the norm you speak about i don't think is entirely applicable to street driving where there is a hell of a lot of visual stimuli, and people, including people on bikes are part of the norm. Unless they're wearing bright colored clothing or have some object that catches your eye, a guy in a grey jacket on a black bike is not going to grab your attention from a big red SUV on your side. Visualize a bike rider against the background of a streetscape. Height doesn't make all that much difference in visibility conditions like this.
can't argue with you about bikers all over the world but in this country car is king (Not that I think that's a good thing mind you. But it is a fact). Our roadways didn't just evolve from old paths and carriage lanes, we've made a concerted effort to build for cars and that's the reality. It would be great if the roads could be shared more but wishing doesn't make it so.

Of course in the days of horse and carriage, access to the stables was necessary and present day curb cuts were grandfathered in but I seem to be missing something here.
You own the garage and the land it sits on, correct? so the DOF is taxing you on what property you own but essentially, unless there's a line on your property assessment that says curb cut, the curb cut is essentially free. That doesn't mean I think it's illegal. I don't.
In all honesty, everyone pays property taxes and everyone is required to take care of the street out front. I'm not trying to make this into an argument- I'm just looking to see a fairer system.

Every homeowner pays property taxes. I don't know what the situation is in Ditmas Park, but buying a house and property taxes doesn't entitle you to a piece of public property. What does that say for others who pay high property taxes but have no curb cuts? You bought a house with a driveway and a garage,and of course you spent more because of that, but if as steve says, the DOT is the owner of the curb cut, you're essentially getting a freebie.
It's obviously not a big problem in Ditmas Park, but in brownstone areas like mine it is.

The hostility is because OP never indicated that(s)he is affected adversely by the construction, or that there is an unsafe condition, or even violations.
It *sounded* as if OP just wants to stop paying rent on a legality. If not, let OP respond.

I did pay rent, but am without heat/hot water. LL is totally unresponsive. I'm reluctant to call 311 and be removed from the building due to the lack of C of O, but don't know how else to get LL to pay attention. Thanks for the helpful responses. I've seen an atty to discuss my options.

It now sounds like you have warranty of habitability issues. Glad you're speaking to attorney. Make sure it's someone who does a lot of landlord/tenant work, cause the CofO problem combined with this will make things tricky.
BTW, if you'd posted that you had no heat/hot water, and that the landlord wasn't responsive, I would've told you not to pay rent and also to see an attorney.

truer words were never spoken, cmu. Well...ok, maybe there are, but thanks for the splash of cold water. Now if we can all just avoid getting exterminated for falling outside poley's favorite demographic and and avoid getting killed by bike psychopath brenda we'll be fine.
