What recourse does the owner of the damaged building have?

Does the owner of the damaged building have to sue the builder/architect/developer or is there a less damaging/expensive method to recover the carrying costs (since it has to be empty) plus the cost of repairs?

I'm very interested/worried about this since the empty lot next to me is getting ready to build. They put up their construction fence yesterday.
