Getting Sec Dep After 5 Yrs

A tenant moved in 5 years ago. At the time of signing the lease, they gave a security deposit check that was never cashed. Now after 5yrs when the renewal lease was signed, landlord wants security deposit. Is it too late to collect from tenant?

Why should it be too late? It could be made as a condition of renewal.

Why do you want the security deposit now after all this time? Do you like the tenant and want to keep them?

You the tenant or the landlord?

If the place isn't rent regulated you could make a reasonable case that the landlord had their chance and you aren't going to pay a deposit just because they never cashed the check.

Make the renewal conditional upon a security deposit. Not cashing it in the first place was dumb, at best.

Huh? Tenant gave security deposit. Landlord didn't take it. Wacky.

The landlord could make it a requirement of the next lease renewal.

What is the matter with this landlord? They sound difficult, unclear, and inconsistent.
