Building Footprint Changed
We're applying for a new C of O and found out that the footprint of the building differs from what's on file. The previous owners enlarged the permitted extension to cover the width of the building. Is there any way around removing this extension? Our central A/C and gas blower would both have to be moved.

I'm no architect, but I assume you could hire an architect and surveyor and have "as built" plans made up and submitted to the DOB.

you need to "legalize" the layout. As the previous poster mentioned, hire an architect, expediter, etc and submit plans to the DOB. Make sure your extension complies with FAR requirements and rear yard rules- if it was legal to do part of the width, chances are you are ok on both FAR and rear yard.

As per 'sam', knowing why are you applying for the new C of O could be useful.
'jelly donut' is right, you'd need to legalize the change.
Unfortunately, in my experience, the odds that there won't be serious, maybe fatal problems w/ the extension in zoning/code terms are very low.

you are probably screwed..the dob has been turned into an atm under bloomberg....you will probably have to tear it down and rebuild it...as builts are finding it harder and harder to get passed

Too bad you don't seem to be in Sunset Park. In these parts, you can build a 5-story building with a 4-story permit and the Bldgs. Dept. looks the other way. So the extension should be a breeze as long as you hire a Sunset Park architect.
