Illegal at 110 4 Ave?

I learned that a building must have a certificate of occupancy for the landlord to be able to rent it out to tenants. I rented at 110 4th Avenue, and found out the building doesn't have the certificate. We moved in, and I already live here!!!? What should I do? Could they throw me out?

You should move out immediately. Obvioulsy, it's very hazardous to live in a place with no c of o.

wow its a robert scarno building...how surprising...btw if your landlord rented to you w/out a valid c of o you could sue his ass and never pay rent..

eman1234, I guess it only applys to buildings with more then 4 units?

certificate of occupancy in place.

Use your common sense -- if the building doesn't seem dangerous, it probably isn't any more dangerous than any of the other buildings around. The C of O will be a major problem for the landlord if he ever wants to sell the building, but I don't think you, as a tenant, really need to worry about it. Might be a sign that your landlord isn't on the ball, and therefore you might have trouble with him for other reasons. That's something you should be alert for and judge for yourself.

You can click that link that eman1234 provided, then click on "objections", and that will show you (I think) all of the things that they've actually failed an inspection on.

What I see on that list looks minor to me -- the cellar door swings the wrong way, some sign needs to be put up better, etc. So you probably aren't too likely to, say, die in an electrical fire a month from now.
