help needed to finish construction

Hey guys!
we are in big trouble!
Since March this year we undergone a renovation/ addition in our house (limestone in BKLYN)
we had an architect an a permit and all went well until the heating season kicked in. Ten days after the biler was activated, our new floor (in addition) had swallen up and we had discovered a major leak through newly installed baseboard heating system. To make a long story short - contractor came down - claimed responsibility - stripped the floor off (350sq. ft) and the plywood foundation down to the concrete. Today he called saying that he is out of money, closing his bussiness or stopping any work due to a lack of funds.
we are in quite a bad situation and seeking an advice.

Was he insured?
You may have to take him to court or report the incident to the DCA if he doesn't fix the job (depending on if the job was completed upon your satisfaction, he may not be held responsible if the work was completed a few months ago...you may have to seek legal help on this issue). This is why most home owners ask for insured Contractors.

Momo: Do you have homeowner's insurance, and did you obtain a certificate of additionally insured from the contractor? Does your coverage include both ongoing operations and completed products and operations? Speak with your insurance agent, and also with your own attorney about how to proceed with the contractor, and how to proceed in general. Contact the other professionals you have worked with during the renovation, especially if one of them recommended this contractor and has a history of working with them. Ask for their input and opinions on repairing the damage. Even though your situation needs immediate attention, get a fuller understanding of your position vis-a-vis this contractor from people you already know, and who already know you, before deciding how to proceed.

You can certainly take him to court but...you will have more expenses and your floor will still not be repaired. First get your home in order (repaired) then worry about the last contractor. You might want to call WMC/Green Construction at 9175446791..I have found them to be very honest and priced very well.

I agree with Kwright. If you decide to sue the contractor, that process will take quite some time. I have some friends who went through a similar situation with a contractor who dropped off of the map. They had to find a way to finish the work and then go after the contractor later. Their story turned out pretty well. I hope the same for you.
