Tenant Vacancy and Rent Stabilization Statement
The DOB is asking for a notarized letter indicating our tenants have all moved out and that the building was never rent stabilized (both correct). I can easily draft something to this effect but was wondering if anyone had a similar experience and can recommend a "DOB friendly" format. Thanks

This makes no sense. The only agency with jurisdiction over this issue is DHCR, not DOB.

There is a check box on the DOB PW-1 form for occupied housing relating to rent control, but I haven't seen thr requirement for the statement.

I wonder if this is possibly a SRO? Perhaps you are talking about an Affidavid of non harrassment?

Thanks for the feedback. The building was not an SRO and the tenants never had leases and when we were going to contract our lawyer asked for a cert of NH and was told it wasn't necessary.
Best we can figure from our objection sheet is DOB is going through a lot of reorg these days and confusion (more than usual) reigns. Other objections to our permit included; required parking is insufficient(it is a townhouse with no curb cut), floor area exceeds the maximum permitted, open space is deficient in area required (we are not altering the building size or footprint in any way).
