Windows and DOB Regs

Does anyone know if you can install a window on the side of an attached building on the top floor if the building next to you is a story shorter? Is it an infringment of your neighbors air rights or just not permissable anyway? I think side yards are required in a new build but these are existing brick buildings so a different situation? Any info is appreciated.

In certain instances you are allowed to put a window. You need to hire an architect or an expediter to tell you for sure. Lots of variables.

They're called "lot line windows" and their construction (or whether they must be sprinkled) and size is regulated by the Building Code because their openings in a fire-rating of the party wall.

If the window is in a wall on the lot line, restrictions apply as to the type of window, sprinkler requirements, etc. Also, if a neighboring window is within a certain vertical dimension away, other restricions apply. An architect would have to look at the exact situation and advise.
