COMPLAINTS reg REAL ESTATE BROKERS
Can anyone tell me where one can file complaints about agents/brokers unethical conduct?

You may try the better busiess bureau.
All monetary crimes can be filed with the district attorneys office.
The easiest solution would be to sue in small claims court as Pro Se.
The clerk will assist you in filling out the forms free of charge.
The fee to bring it to court is nominal.

I guess it's gonna seem like I'm "piling on" after saint marks soul's earlier thread re Ysabelle's accuracy, but it should be pointed out that her first solution is relevant only if the broker is a member of REBNY (by no means all brokers are) and her last solution has no relevance whatsoever unless one can prove actual monetary loss. Even if monetary loss can be proven, I would question whether the $5,000 maximum award in small claims is deterrent to unethical practices in a business with such high-value transactions as real estate. Small claims court has no capability of censure beyond its very limited monetary-award process. If the OP's objective is to prevent the firm's unethical behavior from being repeated, small claims court is a totally useless venue.

Ysabelle is a no nothing blowhard who doles out wrong advice just to hear herself speak. Annoying beyond belief and wrong 99.9% of the time.

OMG. lame lame lame. just call the dept of state and tell them you want to file a complaint. be prepared to give your name, their name, and lots of specific info. if it comes to a hearing be prepared to testify. have your facts straight and hopefully you will stop the bad behavior of unethical brokers.

Call Tappy Phillips from eyewitness news. All the news shows have investigative reporters looking for a feature.
Also, have you tried calling and complaining to the agency/brokerage firm itself? These people do have bosses.

If you call eyewitness news you will end up on television for the world to see and judge you.
Don't try any case in the press.
Do you really want the public harrassing the innocent and the r.e. broker harrassing the complainer?
OP has a right to privacy.
Being on television can make matters worse.
It can go either way.
You are naive if you think

simple solution. post the unethical practices on websites, blogs, anywhere they will hear it. If it has some foundation in truth it will have the intended effect of alerting the realtor and the public of the unethical practices. The realtor will realize that one unsatisfied customer can neutralize the good will of a hundred satisfied customers. Look at e-bay, you fall below 97% approval and nobody's buying.

Keep in mind that hurt feelings do not constitute illegal behaviour.
Dept of State Licensing is your best bet but remeber slander canbe used against you as well. I told a broker once that they had lied to me regarding the taxes on the house I was buying and that i woul report him and he ended up cutting me a check for a years worth of difference

In NYC it is always a good idea to call 311 and get them to transfer you to the appropriate city department and register a complain there too. For this - my guess is they'd transfer you to the Department of Consumer Affairs. Depending on your complaint they may be able to act. If they got several complaints from different people they'd be more likely to do something.

stop sending folks to the wrong venues. the DOS is the only governing body that has jurisdiction over a RE broker or sales agent.
it was also suggested that you contact their managers. that's a great place to start because the managers really don't want bad press so they can nip things pretty quickly. that said: it's still smart to file a complaint with dos because even if the manager fires someone they can take their license to the next office and set up shop there w/o having dealt w/ the actual problem.

I echo 5:43's sentiments about also escalating to their management so these firms can take accountability for the actions of brokers working from them. If their manager does not take appropriate action to review the matter, you then can not only write a complaint about the individual broker, but also about the lack of oversight and supervision at the firm.

OP here. Thanks to you all, lots of good ideas to follow. One would think that reputation is so important in this business some agents AND firms would care more about theirs, but clearly not the case for this one.

Complaining to the agency is often a good idea, but first see if you can sniff out whether the offending individual is a high earner who kicks back less than the standard 50% to the house. That's the kind of deal management will cut with an extra-productive agent so as not to lose the affiliation. If so, then unfortunately the manager will probably blow you off. If the person is marginal anyway, and you're not the first to complain, the house may cut him or her loose.
