lease non-renewel

what's the proper way to tell our tenants we're not renewing their lease so we can renovate the apartment? i want to be fair to them and give them enough notice but then again i've heard around here you shouldn't give them too much notice ....advice anyone?

Oh, this will be a good one. You'll hear from all the overcautious, legalistic, anti-tenant types who'll scare you to death.

My opinion: give them 3 months unless you hate their guts, in which case the legal minimum of 1. If you were in their position, wouldn't you like to know early so you could find something else? Goldem rule applies.

I would let them know now. If you've made the decision - give them as much time as possible. It may be very difficult for them to find another place, and I agree with cmu: if it were you, you would want to know.

let them know as soon as you can. it would only be polite and nice. this would give them enough time to find a new place.

Not a lawyer but had an issue with prior tenant. If you're worried about them not moving, notice legally should be in writing and hand delivered.

Minimum is 1 month from the end of the month that you're giving them notice. I.e. If you tell them September 15, they legally have 'til October 31. If you tell them September 30, still October 1.

OK,

Here is my cunning plan if you are at all worried about them moving out.

Give them the minimum notice of 1 month, but offer to give them an extra month for extra time. In exchange have them sign something extremely painful if they hold over.

Things like:
1. Liquidated damages of $5,000
2. Up front legal costs regardless of fault.
3. First born son
