WHAT IS BETTER?
AS THE OWNER LIVING IN THE HOME (CURRENTLY A ONE FAMILY BUT GOING TO CONVERT INTO LEGAL TWO) IS IT BETTER TO DUPLEX THE 1ST AND BASEMENT FLOORS WITH A 2ND FLOOR RENTAL OR 1ST WITH 2ND FLOORS AND RENT OUT BASEMENT AFTER LEGALIZED? THANKS.

i think it depends how you feel about the garden: do you want it? do you want to share it? do you want the tenant to have sole use?
also, if you rent out the basement (i'm assuming you mean garden level) would you be able to access the basement (cellar)?

Garden rental is generally considered the best configuration. Tenants have their own separate entrance and the owner occupiers upstairs have the full run of the house, stairs etc. Build a deck off the back to access the back yard. You can give the tenants a small patio off the back if you wish separated by a fence. That provides them outdoor space and privacy when you are in the back yard.

Thanks for this advice - I also think the Garden level is the best space to rent out but wanted other thoughts.

I think occupying basement and first with 2nd flr rental is better. I like to have access to backyard and basement for when utility readers come to read meters or if i need to get something stored or put somethng in basement. If your tenants dont mind the intrusion , I guess it would work.

I have the top two floors with one rental on garden and basement floors. Prior owner took out the stairs between my unit and rental so both benefit from extra room and privacy . . . I think.
We share the garden but I access it off my deck. A great setup for me and tenants.
