Does anyone have -- or know the code for what determins
a one two or three family house---

I'm an architect in Brooklyn and I can help. Your post is not very clear or detailed.
The following is based on what I read:
The definition of family and dwelling unit appears in section 12-10 of the Zoning Resolution. Basically each unit must have no less than one bathroom and no more than one kitchen unless you keep a kosher home.
One and two family houses are regulated by the building code and the zoning resolution. Three families and more have to comply with those cods and with Multiple Dwelling Law and Housing Maintenance Code.
At some point in the near future and in some areas this has been incorporated in the codes, New York City will comply with the International Building Code.
I will not go into details or comments of this in this post but it is an important change in New York City codes and construction.
