Hoarder in Coop–Legal Options?


Slightly complicated legal situation here. My coop still has about 6 sponsor-owned units (out of 25); one is a rent-controlled tenant who long predates the building’s becoming a coop. He is a hoarder and has been a constant problem in terms of odor, bugs, etc. We’ve periodically fined the unit owner and demanded they send in cleaners but the tenant is noncompliant at best. Now he has bed bugs. He has allowed an exterminator in to treat the unit but has not done any of the laundry, mattress encasing, follow-up, etc., that would make the extermination successful, and the hoarding behavior obviously only makes it worse.

I have made a referral to Adult Protective Services and they are trying to get in to assess the apartment, but he refuses them access.

The landlord/sponsor is trying to be helpful, but they’re not the most on-the-ball people either.

What do we do? Can anyone either advise on legal options wrt either tenant or owner/sponsor, or recommend a lawyer?

The owner is obviously in breach of the proprietary lease right now, but the last thing we want is to terminate the proprietary lease and end up as the landlords ourselves in this situation!

Shoutout for excellent Real Estate Lawyer/ Attorney


I’m just getting around to posting this, although I refinanced in December. I used Zerline Goodman (Zerline@zlglawyer.com) for the refi closing. She is really great. I was extremely anxious, my experience with real estate lawyers when buying had been less than ideal. But, she put me at ease, promptly responded to my e-mails and calls, explained everything in plain English. Most importantly, she steered me away from an unwise legal decision that I would have made had I followed the bank attorney’s advice (there was a transfer of ownership involved). So I do heartily recommend her and would certainly use her again in a heartbeat!

Contractor Walked off Job


I’m looking for advice on how to deal with a GC / master plumber who has gone way beyond schedule, and now essentially walked off the job.

Incomplete and deficient work is probably between $12,000 and $20,000 (we unfortunately are holding less than that). Our contract (AIA A101-2007) includes a liquidated damages clause for delays; this now amounts to more than $100,000.

The job is an alt-2 gut renovation (3 family home) w/ plumbing and electrical work. The plumbing inspections have not been self-certified; we failed the finish inspection and the piping at the boilers is completely incorrect. I’m already talking with other plumbers about taking over this work.

Minor electrical work remains before an inspection can be called, but I think we’ll have to find a new electrician, and I know it can be difficult/expensive to find someone willing to take this on.

I’m now talking with lawyers, though a lawsuit could be expensive and I’m unsure what we’d actually be able to collect (The GC is a registered corporation; I don’t know if we could go after his personal assets). I’m preparing a complaint w/ DCA (he is a licensed home improvement contractor) and the attorney general. Beyond that – do I just focus getting this job finished, or is it worth pursuing damages?
