roll over security deposit?


We have a tenant who is renewing a one-year lease for a second year. Can we just roll his security deposit over to apply to the next year’s lease?

We have a lease renewal coming up with our tenants, who are good and we hope will stay for another year.

But for the eventuality when they move out, either this spring or in the future, I’m wondering if we could add a clause to their new lease that says we could show the apartment to potential new tenants in the last month of their tenancy if they decided not to renew.

Obviously that would be to avoid a costly vacancy, but is that even allowed under NY law and if so, what do experienced landlords recommend? Is it too invasive?

Boiler won’t turn back on


We had our chimney liner replaced yesterday and the guys who did the work had to turn off the boiler to connect it to the new liner. They turned it back on but then it shut itself off and now won’t turn on. Any ideas what could be the issue? Boiler is pretty new.

Basement Flooded


We just had a flash flood in our backyard and the basement (bottom floor of duplex) had some flooding. It sounds like the tenants may have had some minor damage to their belongings but nothing too major.

We don’t know if our backyard and back vestibule drains were clogged or if the water came up from the storm sewers.

In either case what is our liability as landlords? The lease doesn’t really spell it out and we are somewhat new to this.

Rental Garden


We are new owners of a Crown Heights brownstone that needs a little gardening help.

We’ve made a terrace with pavers in the middle of the back yard with a perimeter needing some plants and mulch around three sides (two strips 15 feet by 3, one 20 feet by 3).

For now the house is a rental and the tenants don’t seem too inclined to do any gardening (or even watering) so we are hoping to put in the most low-maintenance plants possible, either some shrubs, ferns, ground cover or combo thereof. The yard gets pretty decent sun.

We blew our wad on a really nice new fence and the terrace so our budget is low, maybe $200 or so.

Any suggestions? I’ve heard hostra. What about any kinds of evergreen bushes?

Or should we just cover the dirt with mulch to avoid mud and let the tenants fill in with potted plants or whatever?

Smelly Dishwasher


Our tenants are complaining that the dishwasher smells bad after they run it, even if they have scraped all the food off their plates beforehand.

It’s getting stuff clean but they say it smells as if it’s not “breathing properly.” Any thoughts on what that could be?

We have what we hope is a simple landlord/tenant issue and are looking for a quick consultation.

We don’t want to spend too much time or money on it but would like to know what we can legally do regarding an irresponsible person in a group of otherwise very good tenants.
