I have an open question -- maybe someone has researched this. I am new to this site. Now that we're starting to see some deals on new construction, I am wondering what kind of land mines await the bargain hunters. What legal recourse do buyers have if, for example, developers go bankrupt before finishing work or repairs? I am worried that a lot of developers will fail. Do the condo owners end up holding the bag? Happy birthday by the way.

joe....there have been a few posts over the past month or two that have dealt with what has happened at some new developments after you actually occupy. There are examples of roof leaks, heating plant failures and others.

I myself would be very leery of new construction if the developers do not have a long history of projects that come with strong accolades.

The issues that you speak of are certainly valid ones and precede those that I'm speaking of here. You definitely need a real estate attorney if and when you approach any purchase.

The NYT had a really interesting (and scary) article on Sunday about what can happen to condo owners if other owners in their building start to default on maintenance - sounds like a total mess.

I was once told by a friend that one of the buildings on Bayard in Williamsburg was 'structurally unsound' and that in 5 years none of the doors would fit in the door frames - has anybody heard anything like this? I'd love to see some quality analysis on those buildings.

That said, I went to an open house at a toll bros building in LIC yesterday, and the build quality was miles above what I'm seeing in Williamsburg.

A question about these new condo developments: When you buy a new condo and have an inspection done pre-closing, is it customary for the inspector to look over the building as a whole (ie construction quality, systems, etc.) or does s/he just examine the condo unit itself?

thanks so far -- what I'm especially worried about is that the starting maintenance charge reflects the most optimistic scenario - that everything works perfectly. If you end up becoming a shareholder in a half-sold development, and the developer goes under, I'll bet you can end up paying double your share of the repairs over time. When I saw the picture of the cracked brick on Brownstoner last week I got a chill.

When you factor in the future taxes after the abatements go away, you really could be looking at a carry cost many times what they are marketing.

dbcn -- I missed that article, but I can imagine the vicious circle -- as more people fall underwater they stop paying their mortgage -- why pay maintenance if you're going to get evicted anyway? So then as maintenance goes up for the remaining owners, the re-sale values fall to compensate, and more people fall underwater -- but now become spiteful as well. Their building is falling apart and their neighbors are screwing them, and neither one is their fault. The winning strategy for an owner is to avoid being the last to walk away, and living with a bad credit score starts to look better than throwing good money after bad. It could be come a race for the door.

You're never going to be able to predict the strngth of the condo's financials. Look at places in older established buildings first. Find out when the boiler and the roof were last replaced, when the brick was last pointed and what new special capital projects are upcoming (hallways, windows, lobby?).

Additionally, try and find a place that's got a few hundred thousand bucks in reserve. New condo developments are "buyer beware."

sounds like good advice. I'm on the sidelines for a few years though, after convincing myself that we're a long way from the bottom. my interest is part academic, part work (credit mkts), part shameless rubbernecking, part obsessive over-analysis for it's own sake.

To carry over a question from the end of last week:

If I believe interest rates will go up by the time prices slide more than 20 percent in "prime" areas (for townhouses), making carrying costs actually more expensive than they are today, am I Team Bull or Team Bear?

And second, do you think interest rates will rise and when?

On another topic, I was at a book club Sunday and someone there who lives in Astoria claims her friend just rented a "nice" one bedroom apt on 83rd and 2nd (Upper East Side) for $1600. (Size unspecified.)

Another woman at the gathering said she and her husband have seen quite a few new "luxury" condos in the midtown area (54th/7th & 8th Aves) and prices are about $2400 for an 800-sq-foot one bedroom, terrace, doorman, gym, blah blah blah. She claimed she thinks prices will drop to $2000.

They all made fun of the NYT article on falling rents, said the examples of $8,000 apartments were ridiculous.

mopar....I believe that interest rates will continue to rise unless we see some unexpected shock, which I hope we do not. The stock market is behaving rather well despite all the doom and gloom and that means that investors' appetite for more risk is increasing. There's a ton of money parked in US trasuries globally and as that appetite for more risk increases they will sell treasuries which will cause the rates to rise.

I think IR will be driven by washington. if the fed gets their way and starts buying assets, they can control long-term rates better. I don't thing they'll let rates go up before we bottom a few years from now, unless they see signs of inflation. But that's not likely for a while given where we are in the downturn.

I keep hearing about the rents too, chopping 100-200 a month for 2BR in manhattan? if you need more ammo for a bear theory, look at the effect on the already bloated price/rent ratio.

Well, what I think DIBS was saying is that you have to do due diligence, and investigate each coop thoroughly. Scour their financials: underlying mortgage, lines of credit, history of assessments... Any capital improvements planned... Should there be improvements done (elevators, re-pointing, roof, boiler, etc)... Are there still sponsor units... etc...
