Bank of America Posts Quarterly Loss After Bailout (Update4)

Jan. 16 (Bloomberg) -- Bank of America Corp., the largest U.S. bank by assets, posted its first loss since 1991 and cut the dividend to a penny after receiving emergency government funds to support the acquisition of Merrill Lynch & Co.

I want to own that stock,NOT!

The fourth-quarter loss of $1.79 billion, or 48 cents a share, compared with net income of $268 million, or 5 cents, a year earlier, the Charlotte, North Carolina-based company said in a statement today. Results didn't include a $15.3 billion loss at Merrill, acquired this month.

That's gotta hurt!

The losses, coupled with the U.S. lifeline of $138 billion, put more pressure on Chief Executive Officer Kenneth D. Lewis to make the takeovers of Merrill and mortgage lender Countrywide Financial Corp. pay off. Lewis has drawn criticism from analysts for rescuing the two money-losing companies, and the bank told investors on a conference call today to expect more and possibly bigger losses in the quarters ahead.

In at least one instance, investigators say, banking regulators actually approached the bank with the suggestion of falsifying deposit dates to satisfy banking rules -- even if it disguised the bank's health to the public.

Treasury Department Inspector General Eric Thorson announced in November his office would probe how a Savings and Loan overseer allowed the IndyMac bank to essentially cook its books, making it appear in government filings that the bank had more deposits than it really did. But Thorson's aides now say IndyMac wasn't the only institution to get such cozy assistance from the official who should have been the cop on the beat.

Reporting from Sacramento -- State Controller John Chiang announced today that his office would suspend tax refunds, welfare checks, student grants and other payments owed to Californians starting Feb. 1, as a result of the state's cash crisis.

Chiang said he had no choice but to stop making some $3.7 billion in payments in the absence of action by the governor and lawmakers to close the state's nearly $42-billion budget deficit. More than half of those payments are tax refunds.

The controller said the suspended payments could be rolled into IOUs if California still lacked sufficient cash to pay its bills come March or April.

"I take this action with great reluctance," Chiang said at a news conference in his office. But he said that without action to close the deficit, "there is no way to make it through February unscathed."

The payments to be frozen include nearly $2 billion in tax refunds; $300 million in cash grants for needy families and the aged, blind and disabled; and $13 million in grants for college students.

As for the California news, I vaguely recall comptrollers have said this several times before but never made good on the threat because the California assembly voted to increase their budget. But if it happens, it would be a tragedy. Like standing by and watching as people on airplane wings sink into frozen waters.
