Folks;
I call your attention to the commentary thread on the "green church" yesterday, which Brownstoner has now taken off the front page. I added commentary late in the day and this morning, calling for BRG and Brownstoner to be sued by the congragation of this church for libel- BRG for publicly accusing the pastor of fraud, without any evidence, and for Brownstoner to allow such a comment to be published.
I am sick and tired of how folks like BRG have allowed the commentary on this site to degrade. As I put it in one of my comments: one day she'll be talking with Biff or DIBS about truffles and dildos, another day she's accusing a pastor of fraud, without even attempting to offer some evidence.

benson, you normally seem like a very reasonable person -- but come on, calling for lawsuits against the site and a user? that's way, way more dangerous than some errant pseudonymous comments. bad move.

I am a reasonable person, and there is ample precedent for libel lawsuits when someone publicly accuses a specific person (the pastor) of fraud without any evidence, even under a pseuodonym. Corporations do it all the time, and I believe that this congragation should do the same thing. Take it through the courts, and have Brownstoner reveal BRG's identity. Brownstoner should know better than to allow such a comment to be published. He once removed The What's comments when he called for physical violence.

benson is partially right; not on the libel issue though. We do need more passionate discussion here that inflames people to the extent that this green church article did. I have no clue as to anything about this particular issue but I haven't seen it here since the Atlantic Ave Armory/shelter issue and maybe the HOD...which is why many threads degrade into truffle and dildo chat with a smatttering of What crap.

it seems to me that benson is consistently nasty and inflammatory, guilty of the very things he accuses other of, and that he's irate about stories recapped here. The church story came from another source.

Benson, I have to agree with z. While I understand (and partially agree with) your frustration with some of the commentary your suggesting lawsuits isn't the most appropriate way to voice your disgust and outrage. If Brownstoner and commentors were to be open to lawsuits for voicing their opinions just pause for a second to think about where that could lead. Should the owners of a HOTD sue Brownstoner because perhaps the negative comments posted led to a reduced sale price and thus a loss of income?
Good, bad or otherwise BRG's comments are nothing more than her personal opinion.

Dave, that's the empty lot w/ chain link fence I mentioned yesterday in the AY thread. The 2 houses on the corner of Dean and 6th were demolished in less than a week's time it seems.
This corner is somehow included in the AY footprint. Who knows if the new building will ever get built.

I am not calling for a lawsuit to express my frustration. I am calling for a lawsuit because BRG publicly accused a specific person of a serious crime. That is a serious matter, and there should be consequences. She did not just express an opinion. How would you like to be the subject of such a public accusation in such a forum?
As for Brownstoner, I once again state that he knows his responsiblities as a publisher, and he failed them in this case. I've seen numerous cases where he took away comments that contained racial ephithers. Why didn't he act in this case?

It was certainly clear that brownstoner took a firm stand againsy my truffle post. In a way I applaud him for it. Someone needs to take a stand once in a while. Brooklyn seems like a bunch of namby pambies compared to manhattan.

surely you know that the lawsuit you propose would be frivolous and quickly dismissed.
first, brownstoner is clearly off the hook because the communications decency act immunizes websites like brownstoner against liability for comments made by third parties. this immunity applies even if the site's moderator sometimes makes efforts to screen or prunes other comments.
second, taken in context, bayridgegirl's comment was plainly an expression of opinion. see, for example, the recent court decision described in the link below, which involved comments by an anonymous user of a blog that a local business owner watered down his drinks, sold spoiled food, discriminated against certain ages and sexual preferences, and did various other bad things. the court held that "within the context of the blog, no reasonable person would interpret the comments as anything but the authors' opinion." similarly, in this case, no reasonable person would interpret bayridgegirl's single offhand remark as anything but her own speculation and opinion.
so please put your threats on the shelf. if you don't like bayridgegirl, that's fine, but you should find another way to vent your frustration.

I'm not a lawyer, so perhaps you're right. Anyway, my statement was that the pastor/congregation might have a case. Let them decide the matter.
On the larger point: I have no respect for anyone who would make such a statement in such a cavalier way. If Brownstoner doesn't want to improve the caliber of commentary on this blog, so be it.
Finally, I once again state that I've lost respect for Bob Marvin and Montrose (whom I formerly held in high regard) for their "amen" to BRG's post.

Benson, we have liberties in this country, that you and I and everybody else posting, saying, opining on are entitled to. If everytime, a lawsuit is waged against someone who voices a public opinion, everybody at some point would be in court; politicians, writers, journalists, comedians, critics, and the average Joe six-pack, etc.

- Yes, I wonder. Many should have seen this church before the wrecking ball. But, I’m sure many just by looking at photos appreciated the architecturally integrity. I believe it was the only structure in NYC to use Green Ashlar stone in a ‘Serpentine’ effect, dubbing it a ‘Green Serpentine Façade’
This church was situated like many others in NYC. Actually it probably was situated better than others. It was on a huge corner lot. 4th ave about 200’ frontage, Ovington about 175’. There were three (3) buildings on the site. The demolished church (on the corner), to the south on 4th Ave. is the 2 story school building (still standing), and on Ovington Ave. there was a three story townhouse, used as the parsonage (now destroyed).

Holy, Toledo, all these different structures are starting to look like apartment buildings to me!

Why not take a walk on 4th Avenue and really look at the buildings. There are many with great details. Columned entrances, interesting brick patterns, decorative freizes, etc. There’s a couple of buildings in the Art Deco style. So, rub the ‘schlock’ from eyes and look around you.

Biff, I never said that the blog doesn't get traffic, I said that the discussion was not lively. Sure, if the same 8-9 people post 40-50 times a day that adds up to a lot of activity, but having to register prevents many from commenting for reasons discussed in past threads. The result is like an insular HS clique, and far less interesting than olden days.

What is there to respond to? The rantings of a person who fluctuates between two modes: a) silly, juvenile e-mails back and forth on trivial matters and b) emotion-laden rants and accusations on issues of concern to her.
I once again challenge those in the "amen" corner: did you actually see this church in its settings on 4th Ave, prior to it being torn down? Bif? Dibs? Bob Marvin? Montrose?

Not LIKE an insular HS clique, but worse - posters who are (presumably) long out of HS behaving in a HS manner while simplistically denigrating those deemed beneath them, including ACTUAL high-schoolers.

You want to talk about churches and the context they’re in. Let’s do a case study of a few in NYC
Trinity Church – dwarfed by high rise office towers.
St. Barts – look at all the office buildings around this one too.
St. John’s – What is that went up next door?…a building!!
Grace Church – Have you seen the white schlock across the street…Woof.
Btw – this is one of my favorite churches in NYC. You should visit it, but don’t look at the surroundings!! I love knowing that Edith Wharton got married here (even though it was a loveless marriage) – oh, such a silly trivial matter, I bring up)

Everytime I walk by and it's open, I go in.
But, I do that with alot of churches.
And I'm not religious....for me it's about the architecture.

It's a beautiful church. My sister was on 'a church thing' for a bit, and we went every Sunday for quite awhile. I just like the music. I also love the magnolia in the yard on the left.
