Architect Robert Scarano has lost what Crain’s calls his “final attempt to lift a ban barring him from filing documents” with the Department of Buildings. The New York State Court of Appeals ruled against Scarano’s motion to appeal earlier the decision that led to the ban. An appeals court had already upheld the ban earlier this year, and at that point it was noted that other architects with Scarano’s firm could still file plans with the city. So, it’s not clear that his practice will go out of business as consequence of the latest ruling. Buildings Department Commissioner Robert LiMandri said the following in a statement: “Today’s decision sends a clear message that there are serious consequences for those who flout the law to make a profit. In his attempts to circumvent the City’s Building Code and Zoning Resolution, Mr. Scarano showed a disregard for the laws that ensure safety and quality of life for all New Yorkers.”
