A Facebook group called “NYC Board of Standards and Appeals approves too many variances” was launched this week to protest the BSA’s notoriously developer-friendly ways. As of yesterday, the group had more than 30 members. It was started by a woman who is evidently less than pleased about a BSA ruling in her neighborhood: “This scenario is played out in all our boroughs. Community input disregarded. Input which is required by the protocol of the board. A variance was recently granted in my neighborhood to allow a 5 foot frontage on a new construction. Zoning regualtions require 15 feet and most homes on the block have 35 feet or more. Residents, the community board,the local councilman opposed the variance with little effect. It was granted.”

  2. Someone needs to start a Facebook protest to repeal the outlawing of incandescent light. I was at yet another restaurant in Brooklyn last night (Fiore, Italian in Williamsburg) noting the gazillions of Edison bulbs lighting that place. They have more light fixtures than tables!

    It’s gonna be a sad, sad day in Brooklyn when everyone has to stick florescents in their exposed lighting. Maybe it will cause a remodeling boom.

    Um, that’s what a variance is. And having a variance mechanism is required so that zoning regulations don’t become a regulatory taking, which removes all value from a property. Whether there’s a legitimate economic hardship involved with complying with zoning, and whether the variance granted is the minimum necessary to allow viable use of the property, is a case-by-case matter.
