From the Forum: Who is Responsible for DOB Fines When a Boiler Inspection Filing Fee Isn't Paid?
A homeowner is facing a DOB fine over a boiler inspection filing fee that was to have been submitted by their heating company.
A homeowner is facing a DOB fine and is wondering what options they have to resolve the issue. They received a notice from the DOB that there was no boiler inspection on file and they must provide documentation to prove it was submitted. The report and the required filing fee were supposed to be sent in by the heating company they hired, but while the company has turned up the report they can’t find any proof of payment.
The homeowner is now facing a potential $1,000 fine because the company doesn’t have the proper documentation — or perhaps never paid paid the $30 filing fee. What recourse do they have?
